At Madwire, LLC d/b/a Marketing 360® (the "Company," "We," "Us," or "Our"), we respect your privacy and are committed to protecting it through our compliance with this policy.

This policy describes the types of information we may collect from you or that you may provide when you visit any of our websites, including but not limited to marketing360.com, topratedlocal.com, and mymarketing360.com (collectively, our "Websites"), access the Marketing 360®, Websites 360®, and Top Rated Local® software platforms, use any of our mobile applications, or otherwise utilize any of our services (collectively, the "Madwire Services"). This policy also describes our processes for collecting, using, maintaining, protecting, and disclosing that information.

Our Websites and Madwire Services are not intended for children under the age of 16. We do not knowingly collect data relating to children. Please contact us immediately if you believe we may have information related to any child so that we may delete that information.

Please read this policy carefully. If you do not agree with our policies and practices, your choice is not to use our Websites or the Madwire Services. By accessing or using our Websites and/or the Madwire Services, you agree to this privacy policy. This policy may change from time to time; material changes will be communicated by posting the revised policy on our Websites and, where feasible, by email notice to registered users.

This policy applies to information we collect:

  • On our Websites and through email, text, and other electronic communications between you and our Websites;

  • Through our mobile and desktop applications;

  • When you interact with our advertising and applications on third-party websites and services, if those include links to this policy.

It does not apply to information collected by us offline or through other means not described above, or by any third party (including our affiliates and subsidiaries) through any application or content that may link to or be accessible from our Websites.

Neither our Websites nor the Madwire Services are intended for children under 16 years of age. No one under age 16 may provide any personal information to or on the Websites. We do not knowingly collect personal information from children under 16. If you are under 16, do not use or provide any information on our Websites, register for an account, make purchases, or provide any information about yourself, including your name, address, telephone number, or email address.

If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information. If you believe we might have information from or about a child under 16, please contact us immediately at privacy@madwire.com.

4. Information We Collect About You

We collect several types of information from and about users of our Websites and Madwire Services. "Personal data" or "personal information" means any information about an individual from which that person can be identified, excluding anonymized data.

We may collect, use, store, and transfer the following categories of personal data:

  • Identity Data: First name, last name, username or similar identifier, title, gender, or date of birth.

  • Contact Data: Billing address, delivery address, email address, and telephone numbers.

  • Financial Data: Bank account and payment card details.

  • Transaction Data: Details about payments to and from you and other details of products and services purchased from us.

  • Technical Data: IP address, login data, browser type and version, time zone and location, browser plug-in types, operating system and platform, device identifiers, and other technology on the devices you use to access our Websites.

  • Profile Data: Username and password, purchases or orders, interests, preferences, feedback, and survey responses.

  • Usage Data: Information about how you use our Websites, products, and services, including pages visited, links clicked, session duration, and traffic source.

  • Marketing and Communications Data: Your preferences for receiving marketing from us and third parties, and your communication preferences.

  • Inference Data: Inferences drawn from the above categories to create a profile about your preferences, characteristics, predispositions, and behaviors, as required by applicable state privacy laws.

We also collect, use, and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated data does not directly or indirectly reveal your identity. If we combine aggregated data with personal data, we treat the combined data as personal data subject to this policy.

We do not knowingly collect Sensitive Personal Data such as race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, health information, or genetic and biometric data, unless required to provide services you specifically request and with appropriate consent where required by law.

5. How We Collect Your Information

Information You Provide Directly

We collect information you provide when you:

  • Fill in forms on our Websites, including when registering, creating an account, subscribing to our service, or requesting information;

  • Correspond with us (including by email);

  • Complete surveys or participate in research;

  • Carry out transactions through our Websites, including providing financial information to place orders;

  • Report a problem with our Websites or services;

  • Post User Contributions in public areas of our Websites.

User Contributions are posted and transmitted at your own risk. Although you may set certain privacy settings by logging into your account, no security measures are perfect or impenetrable, and we cannot control the actions of other users with whom you choose to share your contributions.

Information Collected Automatically

As you navigate our Websites, we may use automatic data collection technologies to collect information about your equipment, browsing actions, and patterns, including:

  • Details of your visits, including traffic data, location data, and resources you access;

  • Information about your computer and internet connection, including IP address, operating system, and browser type.

Information from Third Parties

We may receive information about you from third parties, including business partners, analytics providers, advertising partners, and data brokers, which we may combine with other information we hold about you.

6. Cookies and Tracking Technologies

Consent-Based Cookies: We only activate non-essential cookies and tracking technologies after you have provided your express, affirmative consent through our cookie consent banner or preference center. You may withdraw consent at any time, and doing so will stop non-essential cookie-based tracking going forward. Withdrawing consent does not affect the lawfulness of processing based on consent prior to its withdrawal.

Types of Cookies We Use

  • Strictly Necessary Cookies: Required for the operation of our Websites (e.g., enabling you to log in, navigate pages, and use secure areas). These cookies do not require your consent and cannot be disabled through our cookie consent tool, though you can block them through browser settings (which may affect site functionality).

  • Analytics/Performance Cookies: Allow us to recognize and count visitors and understand how visitors use our Websites. These cookies are only set with your consent. We use Google Analytics 4 and similar services, which collect information including your IP address (anonymized), browser type, pages visited, and session duration. You may opt out of Google Analytics tracking at any time using the Google Analytics Opt-out Browser Add-on.

  • Functional Cookies: Used to recognize you when you return to our Websites and to personalize content and settings. Only set with your consent.

  • Targeting/Advertising Cookies: Record your visit, pages visited, and links followed so we and our advertising partners can serve advertising relevant to your interests. Only set with your consent.

Flash Cookies and Other Local Storage

Certain features of our Websites may use Flash local stored objects (Flash cookies) or HTML5 local storage. These are not managed by the same browser settings as browser cookies. We implement consent requirements for these technologies consistent with our approach to standard cookies.

Web Beacons and Pixel Tags

Our Websites and email communications may contain small electronic files known as web beacons, clear GIFs, or pixel tags that permit us to count users who have visited pages, opened emails, and to gather related statistics. These only operate in conjunction with cookies and are subject to the same consent requirements.

Third-Party Tracking Technologies

Some content or applications on our Websites are served by third parties, including advertisers, ad networks, content providers, and analytics providers. These third parties may use cookies and similar technologies to collect information about you when you use our Websites. We contractually require third-party advertising and analytics partners to honor user consent signals and honor opt-out requests. We do not control third-party tracking technologies but we require our partners to comply with applicable privacy laws.

You can manage cookie preferences through:

  • Our Cookie Preference Center, available at all times via the "Cookie Settings" link on our Websites;

  • Your browser settings, which allow you to refuse some or all cookies or to be alerted when cookies are set;

  • The Network Advertising Initiative (NAI) opt-out tool at optout.networkadvertising.org;

  • The Digital Advertising Alliance (DAA) opt-out tool at optout.aboutads.info;

  • The Global Privacy Control (GPC) browser signal, which we honor as a valid opt-out of sale and targeted advertising where required by applicable law.

7. URL Passthrough and Analytics Parameters

We use a technique called URL passthrough in connection with our analytics and advertising measurement tools, including Google Analytics 4 and Google Ads. URL passthrough is a privacy-preserving measurement method that enables session continuity and conversion tracking across pages of our Websites without relying on cookies when your consent for analytics or advertising cookies has not been granted or has been denied.

How URL Passthrough Works

When you navigate between pages on our Websites, our systems may append certain parameters to URLs as query strings. These parameters may include:

  • _gl – A Google Analytics linker parameter used to stitch sessions across pages without a persistent analytics cookie;

  • gclid – A Google Click Identifier appended to URLs when you arrive at our site after clicking a Google Ad, used to attribute conversions;

  • dclid – A Display Click Identifier used similarly for Google Display ads;

  • gad_source – Identifies the ad source for attribution purposes.

These parameters are used solely within our own domain for session-level analytics and ad conversion measurement. They are not used to track you across unrelated websites, are not shared with third parties beyond our analytics and advertising service providers, and are designed to function as a less invasive alternative to cookie-based tracking.

Consent and URL Passthrough

URL passthrough is activated in the following circumstances:

  • When you have not consented to analytics or advertising cookies, URL passthrough may be used as a limited, cookieless measurement alternative to enable basic session and conversion tracking;

  • When you have consented, URL passthrough may operate alongside cookies to improve measurement accuracy.

URL passthrough parameters are temporary and session-based. They do not create a persistent profile tied to your device beyond the current session. You may prevent URL passthrough parameters from being appended by disabling JavaScript on our site or using a browser extension that strips tracking parameters from URLs; however, this may affect the functionality of our Websites.

Google Consent Mode

We implement Google Consent Mode on our Websites. This framework allows us to communicate your cookie consent choices to Google's measurement and advertising tags, adjusting how those tags behave based on your consent status. When consent for ads or analytics cookies is denied, Google Consent Mode enables Google to model conversions and traffic patterns using aggregated, anonymized data while honoring your consent choice.

8. How We Use Your Information

We use information that we collect about you or that you provide to us, including personal information, to:

  • Present our Websites and their contents to you;

  • Provide you with information, products, or services that you request from us;

  • Provide you with notices about your account/subscription, including expiration and renewal notices;

  • Carry out our obligations and enforce our rights arising from any contracts between you and us, including for billing and collection;

  • Notify you about changes to our Websites or any products or services we offer;

  • Allow you to participate in interactive features on our Websites;

  • Display advertisements to our advertisers' target audiences (without disclosing your personal information for these purposes without your consent);

  • Conduct analytics and improve our Websites, products, and services;

  • Detect, prevent, and respond to security incidents, fraud, or illegal activity;

  • Comply with legal obligations;

  • Fulfill any other purpose disclosed to you when you provide the information, or with your consent.

10. Disclosure of Your Information

We may disclose aggregated, non-identifying information about our users without restriction. We may disclose personal information we collect or that you provide:

  • To our subsidiaries and affiliates;

  • To contractors, service providers, and other third parties who support our business operations and are bound by contractual confidentiality and use restrictions;

  • To a buyer or successor in connection with a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of Madwire assets;

  • To third-party marketing partners only with your express opt-in consent;

  • To analytics and advertising service providers including Google LLC, subject to the cookie consent preferences you have expressed;

  • To comply with any court order, law, or legal process, including government or regulatory requests;

  • To enforce our terms of use and other agreements, including for billing and collection;

  • To protect the rights, property, or safety of Madwire, our customers, or others, including exchanging information for fraud protection and credit risk reduction;

  • For any other purpose disclosed by us when you provide the information, or with your consent.

We do not sell your personal information to third parties for monetary consideration, except as necessary to provide the services you have requested. In states where "sale" is defined broadly under applicable law (e.g., California, Colorado, Virginia, and others), we provide opt-out rights as described in the State-Specific Privacy Rights section below.

11. Your Choices and Rights

Marketing Communications

You may opt out of receiving marketing communications from us at any time by contacting us at privacy@madwire.com or by using the unsubscribe link included in marketing emails. Opting out of marketing does not affect transactional or service-related communications.

Cookies and Tracking

You may manage your cookie preferences at any time through our Cookie Preference Center or through the methods described in Section 6.

Accessing and Correcting Your Information

You may send us an email via our contact link or to privacy@madwire.com to request access to, correction of, or deletion of personal information you have provided to us. We cannot delete your personal information without also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Global Privacy Control (GPC)

We honor the Global Privacy Control (GPC) browser signal as a valid opt-out of the sale of personal data and the use of personal data for targeted advertising, where required by applicable state law. You may enable GPC through a supported browser or browser extension.

12. Data Security

We have implemented administrative, technical, and physical measures designed to protect your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Access to your personal data is limited to employees, agents, contractors, and other third parties who have a legitimate business need to know. Such parties process your personal data on our instructions and are subject to a duty of confidentiality.

We have put in place procedures to respond to any suspected personal data breach and will notify you and any applicable regulator where we are legally required to do so.

The security of your information also depends on you. You are responsible for keeping your account password confidential. Unfortunately, no internet transmission is completely secure, and we cannot guarantee the security of information transmitted to our Websites.

13. Data Retention

We retain your personal data only for as long as necessary to fulfill the purposes for which we collected it, including to satisfy any legal, accounting, or reporting requirements. To determine the appropriate retention period, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process it, and applicable legal requirements.

In general, we retain customer account data for the duration of the customer relationship plus a period of up to seven (7) years to comply with tax, financial reporting, and contract-related obligations, unless a shorter or longer period is required by applicable law.

14. State-Specific Privacy Rights

In addition to any rights described elsewhere in this policy, residents of the following states may have additional privacy rights under their respective state laws. To exercise any of the rights listed below, please submit a verifiable consumer request to privacy@madwire.com or through our Privacy Request Portal. We will respond within the timeframe required by applicable law (generally 45–60 days, with possible extension). We will not discriminate against you for exercising your privacy rights.

California Residents — CCPA / CPRA

California residents have rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). These include the right to:

  • Know what personal information we have collected, used, disclosed, and sold or shared;

  • Delete personal information we have collected, subject to certain exceptions;

  • Correct inaccurate personal information;

  • Opt out of the sale or sharing of your personal information, including for cross-context behavioral advertising;

  • Limit the use and disclosure of sensitive personal information;

  • Non-discrimination for exercising your rights.

Colorado Residents — Colorado Privacy Act (CPA)

Colorado residents have the right to: (1) opt out of the processing of personal data for targeted advertising, sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects; (2) access personal data we process about you; (3) correct inaccuracies; (4) delete personal data; and (5) obtain a portable copy of personal data in a readily usable format. We honor the GPC as a valid opt-out signal under Colorado law. To submit a request, contact privacy@madwire.com. If we deny your request, you may appeal by contacting us. If you are unsatisfied with the result, you may contact the Colorado Attorney General.

Virginia Residents — Consumer Data Protection Act (CDPA)

Virginia residents have the right to: (1) confirm whether we process your personal data; (2) access your personal data; (3) correct inaccuracies; (4) delete your personal data; (5) obtain a portable copy; and (6) opt out of the processing of personal data for targeted advertising, sale, or profiling. We do not process sensitive data about Virginia residents without consent. Submit requests to privacy@madwire.com. You may appeal a denial of your request by contacting us; unsatisfied appeals may be directed to the Virginia Attorney General.

Connecticut Residents — Connecticut Data Privacy Act (CTDPA)

Connecticut residents have rights to access, correct, delete, and obtain a portable copy of personal data, and to opt out of the sale of personal data, targeted advertising, and profiling. We honor the GPC as a valid opt-out. Submit requests to privacy@madwire.com. Appeals may be directed to us and ultimately to the Connecticut Attorney General.

Texas Residents — Texas Data Privacy and Security Act (TDPSA)

Effective July 1, 2024, Texas residents have the right to confirm whether we process personal data about them, access it, correct inaccuracies, delete it, obtain a portable copy, and opt out of the sale of personal data, targeted advertising, or profiling that produces legal or similar significant effects. Submit requests to privacy@madwire.com.

Oregon Residents — Oregon Consumer Privacy Act (OCPA)

Effective July 1, 2024, Oregon residents have the right to confirm, access, correct, delete, and obtain a portable copy of their personal data, and to opt out of targeted advertising, sale of personal data, and profiling. Oregon's law provides additional protections for sensitive data and does not contain certain exemptions found in other state laws. Submit requests to privacy@madwire.com.

Montana Residents — Montana Consumer Data Privacy Act (MCDPA)

Effective October 1, 2024, Montana residents have rights to confirm, access, correct, delete, and obtain a portable copy of personal data, and to opt out of sale of personal data and targeted advertising. Data collection is limited to what is adequate, relevant, and reasonably necessary. Submit requests to privacy@madwire.com.

New Jersey Residents — New Jersey Data Privacy Act (NJDPA)

Effective January 15, 2025, New Jersey residents have the right to confirm, access, correct, delete, and port personal data, and to opt out of the processing of personal data for sale, targeted advertising, or profiling. We honor the GPC as a valid opt-out under New Jersey law. Submit requests to privacy@madwire.com.

Delaware Residents — Delaware Personal Data Privacy Act (DPDPA)

Effective January 1, 2025, Delaware residents have the right to confirm, access, correct, delete, and port personal data, and to opt out of the processing for targeted advertising, sale, and profiling. Submit requests to privacy@madwire.com.

Iowa Residents — Iowa Consumer Data Protection Act (ICDPA)

Effective January 1, 2025, Iowa residents have the right to confirm, access, and obtain a portable copy of personal data and to opt out of the sale of personal data and targeted advertising. Note: Iowa's law does not grant the right to delete or correct data collected by third parties. Submit requests to privacy@madwire.com.

New Hampshire Residents — New Hampshire Privacy Act (NHPA)

Effective January 1, 2025, New Hampshire residents have the right to confirm, access, correct, delete, and port personal data, and to opt out of targeted advertising, sale, and profiling. Submit requests to privacy@madwire.com.

Tennessee Residents — Tennessee Information Protection Act (TIPA)

Effective July 1, 2025, Tennessee residents have the right to confirm whether we process their personal data, obtain a copy, and request correction of inaccuracies. We comply with TIPA's requirements for covered businesses meeting the applicable thresholds. Submit requests to privacy@madwire.com.

Minnesota Residents — Minnesota Consumer Data Privacy Act (MCDPA)

Effective July 31, 2025, Minnesota residents have the right to confirm, access, correct, delete, and obtain a portable copy of personal data, and to opt out of targeted advertising, sale, and profiling. Submit requests to privacy@madwire.com.

Maryland Residents — Maryland Online Data Privacy Act (MODPA)

Effective October 1, 2025, Maryland residents have the right to confirm, access, correct, delete, and port personal data, and to opt out of targeted advertising, sale, and profiling. Maryland's law imposes stricter requirements on the processing of sensitive data, limiting its collection to what is strictly necessary to provide the requested product or service. Submit requests to privacy@madwire.com.

Indiana Residents — Indiana Consumer Data Privacy Act (ICDPA)

Effective January 1, 2026, Indiana residents will have the right to confirm, access, correct, delete, and port personal data, and to opt out of targeted advertising, sale, and profiling. The law applies to businesses that process the personal data of at least 100,000 Indiana residents, or 25,000 residents when more than 50% of revenue derives from selling personal data. Other States

Privacy laws are rapidly evolving across the United States. Even if your state is not listed above, you may have rights under applicable state law. We are committed to honoring consumer privacy rights as required by law in your jurisdiction. If you are unsure whether you have rights under a law not listed here, please contact us at privacy@madwire.com and we will work to address your request in good faith.

How to Submit a Rights Request

To exercise any applicable privacy rights, please submit a verifiable request to us by:

  • Using our Privacy Request Portal; or

We may need to verify your identity before processing your request. We will confirm receipt of your request within 10 business days and respond fully within the timeframe required by applicable law (generally 45 days, extendable by an additional 45 days with notice).

15. International Transfers

Data provided to us is processed in the United States. If you are located outside the United States, please be aware that information we collect may be transferred to and processed in the United States, where data protection laws may differ from those in your country.

For transfers from the European Economic Area (EEA) or Switzerland, we rely on Standard Contractual Clauses (SCCs) approved by the European Commission, or other lawful transfer mechanisms, to ensure an adequate level of protection for personal data. We require all sub-processors to agree to appropriate transfer mechanisms as a condition of our agreements with them.

References in our prior policies to Commission Decision 2010/87/EU have been updated to reflect the current Standard Contractual Clauses adopted by the European Commission in its Implementing Decision (EU) 2021/914.

16. Changes to Our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat your personal information, we will notify you by email to the address associated with your account and/or through a prominent notice on our Websites' home page. The date the policy was last revised is identified at the top of this page. You are responsible for ensuring we have an up-to-date, deliverable email address for you, and for periodically reviewing this policy for changes.
